Statutory Definitions

Agent Contract — La. R.S. 4:421(1) (Professional Sports Representation only) “Any contract or agreement, whether written or oral, under which an athlete authorizes an athlete agent to negotiate or solicit on behalf of the athlete for the employment of the athlete by one or more professional sports teams or organizations.”

Endorsement Contract — La. R.S. 4:421(11) (including NIL deals) “An agreement under which an athlete is employed or receives anything of value to permit the use, promotion, or association of the athlete's name, image, and likeness, publicity, reputation, following, fame, or other personal or commercial attributes, whether or not related to the athlete's athletic ability or performance.”

Agent Contracts only For professional sports representation only. Players association certification required. Endorsement Contracts only Agents who only represent athletes for endorsement, NIL (name, image, and likeness) and revenue-sharing deals. Players association certification not required. Both Professional sports representation and endorsement / NIL contracts. Players association certification required.
